Section 11 PC Act after 2018: Undue Advantage without Adequate Consideration
Section 11 addresses a conflict-laden benefit even where a specific corrupt official act is not proved. It applies when a public servant accepts, obtains, attempts to obtain or agrees to accept an undue advantage without consideration, or for consideration known to be inadequate, from a person connected with official business.
The required relationship
The giver must be known by the public servant to be concerned, likely to be concerned or interested in a proceeding or business transacted or about to be transacted by that public servant. The provision also reaches a person connected with the official functions of the public servant or a subordinate, and specified related or interested persons.
Why Section 11 differs from Section 7
Section 7 focuses on an advantage connected to improper or dishonest public duty. Section 11 targets receipt from an interested source without proper consideration. The prosecution must still prove knowledge, the prohibited source and the absence or inadequacy of consideration.
Gifts and transactions
A festive gift, discounted property, interest-free loan, free travel or asset transferred to a relative may attract scrutiny. Genuine market transactions supported by valuation, payment and disclosure may rebut the allegation. Service-rule permission is relevant but does not necessarily decide criminal liability.
Evidence
The transaction chronology, official file, relationship with the giver, market value, source of payment, disclosures and communications are central. “Inadequate” consideration requires a reasoned comparison, not speculation based on later price appreciation.
Section 11 protects impartial administration by addressing benefits from interested persons before prosecutors can necessarily prove an express quid pro quo.
