Criminal Misconduct after 2018: How Section 13 Was Narrowed
The 2018 amendment substantially narrowed criminal misconduct. The former Section 13(1)(d), often used for abuse of position and pecuniary advantage, was omitted. The present Section 13 principally covers dishonest or fraudulent misappropriation of entrusted property and intentional illicit enrichment during the period of office.
Misappropriation
Section 13(1)(a) addresses a public servant who dishonestly or fraudulently misappropriates, converts for personal use, or allows another person to misappropriate property entrusted to or under the public servant’s control. Entrustment, control, dishonest intent and conversion must be proved.
Illicit enrichment
Section 13(1)(b) applies where a public servant intentionally enriches himself illicitly during office. Possession of pecuniary resources or property disproportionate to known sources of income raises the statutory presumption unless satisfactorily accounted for.
Date of conduct
Conduct completed before 26 July 2018 may remain governed by the pre-amendment offence and the saving provisions. Later deletion does not automatically erase liability already incurred, while Article 20(1) prohibits retrospective creation or enhancement of penal liability.
Administrative error is not misconduct
After the amendment, an irregular decision or loss to government cannot simply be forced into Section 13. The exact surviving ingredients must be pleaded. Other offences, including Section 7, conspiracy, cheating or breach of trust, may apply if independently established.
The narrowed provision reflects a deliberate legislative choice: criminal misconduct now requires proof within defined categories, not a general allegation that official discretion was exercised badly.
