Who May Investigate a PC Act Offence? Understanding Section 17

Section 17 restricts investigation of PC Act offences to police officers of specified rank unless a competent Magistrate orders otherwise. The safeguard seeks experienced supervision for serious allegations against public servants.

Rank requirements

The applicable rank depends on the investigating establishment and area specified in Section 17. State authorisation may permit an Inspector to investigate in defined circumstances. A disproportionate-assets offence under Section 13(1)(b) requires an order of a police officer not below the rank of Superintendent of Police.

Authorisation must be real

The prosecution should produce the general or special authorisation where a lower-ranked officer acts. Courts examine competence at the relevant investigative stage, not merely the officer who ultimately signed the report.

Effect of irregularity

Every defect does not automatically nullify the trial. The court considers the nature of the violation, statutory language, timing of objection and prejudice or failure of justice. A deliberate bypass of a mandatory safeguard is more serious than a curable clerical error.

Section 17 and Section 17A

Rank competence does not replace previous approval under Section 17A where the allegation is relatable to an official recommendation or decision. The investigator may need both legal foundations. Conversely, Section 17A’s trap exception does not dispense with the rank requirement.

For post-2018 cases, the investigation file should therefore contain a clear authority chain: competent officer, authorisation, Section 17A decision where applicable and supervisory order for disproportionate assets.
